Fidelity Pressure Washing LLC – Terms & Conditions
Customer Contract
This Customer Contract (the “Contract”) is made between Fidelity Pressure Washing LLC (“Company”) and Client, collectively referred to as the “Parties.” The Contract becomes effective once the Client accepts the Company’s proposal or estimate.
1. Acceptance of Terms
By accepting an estimate, the Client agrees to all terms outlined in this Contract and authorizes the Company to perform the job. The Company is not responsible for pre-existing damages or damages not caused by negligence.
2. Binding Agreement
This Contract is the entire agreement and supersedes all previous discussions. Any modifications must be in writing and signed by both Parties.
3. Authorizations
- Client grants access to the property for assessment, service, and follow-up.
- Water access via outdoor spigot must be available; additional fees apply if the Company provides water.
- The Company uses its own power sources and documents spigot condition.
- Services cannot be rendered if construction is ongoing. A $150 fee applies for cancellations due to construction.
- Rescheduling due to weather or emergencies will be done on the next available business day.
4. Payment Terms
- Payment is due upon job completion unless otherwise agreed.
- Late payments over 10 days incur a 7% fee. 30+ days overdue may result in legal action and refusal of future services.
- Net 30 accounts must pay within 30 days to avoid penalties.
5. Risks and Liability
- The Company is not liable for damage due to poor maintenance, neglect, or low-quality materials.
- Pre-existing damages will be documented.
- The Company is not liable for pre-existing damage to plants or leaf burn from midday sun.
6. House Wash Acknowledgment
- Water spigot must be available.
- Oxidation or flaws may become more visible after cleaning.
- Electrical outlets should be shut off prior to arrival.
- The Company is not liable for weep hole drips or window spotting.
- Basic window cleaning is included; purified water window cleaning is available at an additional cost and requires screen removal by the Client.
7. Roof Treatment Acknowledgment
- Water spigot must be available.
- The solution used kills roof growth but results may vary. The Client may request a waiver if forceful cleaning is desired.
- Granular loss may be visible post-cleaning.
8. Touch-Ups on Roofs
- Dead algae may take 6–8 weeks or more to disappear.
- Touch-ups are free if required per the initial quote.
9. Client’s Responsibilities on Service Date
- Shut all doors and windows.
- Remove pet droppings.
- Shut off all exterior electrical outlets.
- Remove window screens and sensitive materials.
- Keep pets and children indoors.
- Provide accessible water supply with 40 PSI pressure.
10. Exclusions & Limitations
- A 20–30% non-refundable deposit is required to secure service.
- Fees:
- $55 for water source issues.
- $150 for late cancellations or if construction prevents service.
- $100 if follow-up finds no fault with the Company.
- $100 if window screens are not removed beforehand.
- $45 processing fee for returned checks.
- The Company is not responsible for:
- Stains not fully removed.
- Undisclosed sensitive surfaces.
- Water intrusion due to poor seals.
- Specific exclusions such as unreachable areas, wasp nests, oxidation, paint issues, faulty outlets, fogging windows, etc.
11. Content Use & Release
Client grants permission to use media (photos, videos, reviews) for marketing without compensation. Company may place a sign on the property for up to 7 days.
12. Damages Liability
The Company is liable only for damages due to negligence. Damages must be reported within 2 days. The Company has 30 days to inspect and resolve.
13. Severability
If any part of this Contract is invalid, the rest remains enforceable.
14. Attorneys’ Fees
The non-breaching party may recover legal fees and costs.
15. No Waiver
Failure to enforce any term is not a waiver of future enforcement.
16. Choice of Law
Florida law governs this Contract.
17. Amendments
Only written and signed amendments are valid.
18. Jurisdiction
All disputes shall be resolved in Davidson County, Tennessee.
